November 16, 2020 Special Meeting
The Lakota City Council held a special meeting on November 16th, 2020, at the City Hall. President Bill Solberg called the meeting to order at 6:00 p.m. All Council Members were present, except for Members D. Mattern and Mayor Hooey who were absent. Member Vasichek, City Attorney Tenneson and AE2S representatives Donovan Voeller and Meredith Quinn were all on speaker phone.
President Solberg called the meeting to order. President Solberg stated the city is needing to sort out the water tower project with Caldwell Tanks since the city has not heard a response from them regarding final payment and the allowance of the project.
Engineer Voeller stated USDA has reservations with holding a final walk thru of the project as there are outstanding invoices and there still is the ongoing issue of the allowance portion of the project that Caldwell originally forgot to include in their bid price. Member Vasichek stated he thought remains the same with the allowance and that it is an error on Caldwell Tanks and they need to stand by their bid price. Member Vasichek stated he is opposed to conceding to Caldwell Tanks.
Attorney Tenneson stated he agrees with Member Vasichek on the allowance portion of the contract and the error lies with Caldwell Tanks. Attorney Tenneson stated he would be drafting a letter requesting a response from Caldwell Tanks by December 2nd, 2020 including the provided change order #3 reflecting the water meter allowance ($120,787.74), paint damage to vehicles ($6,173.53) and liquidated damages ($25,825.23).
Member Vasichek made a motion to send a change order to Caldwell Tanks reflecting the decrease of $152,786.50 along with a letter from the City Attorney Tenneson, seconded by Member Hess. On a roll call vote, all members voting in favor. Motion carried.
Auditor Vasichek stated the committee that puts the Holiday Fest together has requested permission to light fireworks during the event scheduled for December 5th, 2020.
Member Hess made a motion to allow fireworks to be lit for the Holiday Fest event by the event planning committee on December 5, 2020, seconded by Member R. Mattern. On a roll call vote, all members voting in favor. Motion carried.
Member Hess made a motion to adjourn the meeting, seconded by Member R. Mattern. Motion carried.
