CHAPTER FOURTEN - OFFENSES

ARTICLE 1 - General

14.0101 Minors Forbidden to be on the Streets After Eleven O'Clock (11:00) P.M.

      1. It shall be unlawful for any child under the age of fourteen (14) years of age to be in or upon the streets, alleys, parks or public places in the city after eleven o'clock (11:00) at night, without the written consent of the parent or guardian of said child, unless accompanied by a parent or guardian, or some adult authorized by such parent or guardian.

      2. It shall be unlawful for any parent, guardian, or other person having the legal care and custody of any child under fourteen (14) years of age to allow or permit any such child, ward or other person under such age, while in such legal custody, to go or to be in or upon any of the streets, alleys, parks or public places in the city within the time prescribed by or contrary to, the provisions of this Ordinance.

14.0102  Criminal Contempt

To the extent criminal contempt is a Class B Misdemeanor, the governing statute is Section 40-18-14, NDCC.

14.0103  Fleeing a Police Officer

To the extent fleeing a police officer is a Class B Misdemeanor, the governing statute is Section 12.1-08-11, NDCC.

14.0104  Simple Assault

To the extent simple assault is a Class B Misdemeanor, the governing statute is Section 12.1-17-01, NDCC.

14.0105  Sexual Assault

To the extent sexual assault is a Class B Misdemeanor, the governing statute is Section 12.1-20-07, NDCC.

14.0106  Harassment

To the extent harassment is a Class B Misdemeanor, the governing statute is Section 12.1-17-07, NDCC.

14.0107  Criminal Mischief

To the extent criminal mischief is a Class B Misdemeanor, the governing statute is Section 12.1-21-05, NDCC.

14.0108  Tampering with or Damaging a Public Service

To the extent tampering with or damaging a public service is a Class B Misdemeanor, the governing statute is Section 12.1-21-06, NDCC.

14.0109  Consent as a Defense

The governing statute concerning consent in regard to 14-0107 and 14-0108 is Section 12.1-21-07, NDCC.

14.0110  Definitions

The governing statute concerning definitions in regard to 14-0107 and 14-0108 is Section 12.1-21-08, NDCC.

14.0111  Criminal Trespass

To the extent criminal trespass is a Class B Misdemeanor, the governing statute is Section 12.1-22-03, NDCC.

14.0112  Consolidated Theft Offenses

The governing statute is Section 12.1-23-01, NDCC.

14.0113  Theft of Property

To the extent theft of property is a Class B Misdemeanor, the governing statute is Section 12.1-23-02, NDCC.

14.0114  Theft of Services

To the extent theft of services is a Class B Misdemeanor, the governing statute is Section 12.1-23.03, NDCC.

14.0115  Theft of Property Lost, Mislaid or Delivered by Mistake

To the extent theft of property lost, mislaid or delivered by mistake is a Class B Misdemeanor, the governing statute is Section 12.1-23.04, NDCC.

14.0116  Theft Punishable Under City Ordinances

To the extent theft punishable under city ordinances is a Class B Misdemeanor, the governing statute is Section 12.1-23-05, NDCC.

14.0117  Misapplication of Entrusted Property

The governing statute is Section 12.1-23-07, NDCC.

14.0118  Retail Theft

Retail theft shall be defined and enforced pursuant to Chapter 51-21, NDCC, as applied to Class B Misdemeanors.

14.0119  Defenses and Proof as to Theft and Related Offenses

14.0120  Definitions

14.0121  Theft of Cable TV Service

14.0124  Engaging in a Riot

14.126 Disorderly Conduct

The governing statute is Section 12.1-31-01, NDCC.

14.127 Business or Labor on Sunday

To the extent business or labor on Sunday is a Class B Misdemeanor, the governing statute is Chapter 12.1-30, NDCC.

14.0128  Humane Treatment of Animals

The governing statute is Section Chapter 36-21.1, NDCC, relating to infractions and Class B Misdemeanors.

14.0129  Persons Less than Twenty-One (21) Years Prohibited

The governing statutes are Sections 5-02-06 and 5-01-08, NDCC.

14.130 Misrepresentation of Age - Obligations of Licensee

The governing statute is Section 5-01-08.1, NDCC.

14.0131  Bottle Clubs Prohibited

The governing statute is Section 5-01-10, NDCC.

14.0132  Objectionable Materials or Performance - Display to Minors

The governing statute is Section 12.1-27.1-03.1, NDCC.

14.0133  Sentencing

Shall be set in accordance with Chapter 12.1-32, NDCC.
